Public Spaces Unattended Property Act 2022

Beginning in November 2022, these laws give councils strong powers to make owners be responsible for their property left in public – on a case-by-case basis.

Abandoned property is called ‘Unattended property’ under the law.

What is Unattended Property?

Property not under the ‘direct control or supervision of a responsible person’. For a car, trailer, motorbike or anything that could have a number plate, unattended means unregistered.

The vehicle must be on public land. Vehicles on private land are not classed as unattended.

Reports are assessed on a case-by-case basis and action is at the discretion of council officers.

What Council requires to act:

  • Registration plate details from the vehicle, if it has one.
  • Make, model and colour of vehicle.
  • How long it has been parked in the location.
  • Note: The process before an abandoned vehicle can be impounded can take 6 - 8 weeks.
